INPI leaves Ministry of Economy and returns to MDIC

The new government has just published, in the Federal Official Gazette, Decree nº 11.340, of January 1, 2023, which determines the return of the INPI (National Institute of Industrial Property), as well as the Intellectual Property policies – previously allocated in the Ministry of Economy -, for the Ministry of Development, Industry, Commerce and Services (MDIC). The Decree, in its article Art. 46, establishes that it is incumbent upon the Department of Intellectual Property Policy and Metrology, under the scope of the MDIC:

I – Formulate and implement programs, policies and actions related to intellectual property and technology transfer;

II – Formulate and implement programs, policies and actions related to metrology, standardization and industrial quality;

III – Advise and coordinate the government’s position on intellectual property policies, technology transfer, metrology, standardization and industrial quality; and

IV – Exercise the Executive Secretariat of the Interministerial Group on Intellectual Property, and provide technical assistance to it.
