Essential Patents and FRAND Licenses

The Essential Patents and FRAND Licenses Commission aims to expand, in Brazil, international debates regarding its object of study. The Commission promotes regular meetings, technical events and supports ABPI with resolutions, opinions and other studies, positioning the Association as a protagonist in the discussion on the topic at a national level.

Deepening topics such as the behavior of the parties in the negotiation phase, cross-border procedural issues, the essentiality of patents and the granting of injunctions in SEP infringement actions, among others, is of special importance for the qualification and predictability of judicial decisions on the theme and to encourage efficient, fair and transparent business practice, allowing investments in research and development and the definition of technical standards for interoperability to result in technological advances for society, benefits for consumers and legal security for agents economic.
