“A generic compulsory license is a bomb against innovation”, said today, 29, ABPI’s vice president, Gabriel Leonardos, in a Public Hearing at the Social Security and Family Commission of the Chamber of Deputies on the granting of non-voluntary licenses of patents. He proposed the “punctual and necessary use” of the compulsory license ”and criticized the generic use of this device for the treatment of covid-19“ I ask for consideration in the assessment of the harmful effects of any measure of a generalized non-punctual, non-localized compulsory license ”, said.
Leonardos defended a “more dispassionate use” of compulsory licenses and denied that the patent system is an obstacle to health. “Patents do not prevent access to health, what ineffective public policies are,” he said. “Are we going to take a unilateral approach and go against a multilateral treaty? If the government wants, it can decree the compulsory license in one hour ”, remembering that this device was included in international law in the revision of The Hague, of the Paris Convention, in 1925.
