The Minister Dias Toffoli, of the STF (Supreme Federal Court), granted in the beginning of the evening of this Wednesday (7) the injunction required by the PGR (Attorney General’s Office), suspending the validity of the Sole Paragraph of Art. 40 of the Law Industrial Property Law (Law 9.279 / 96), which provides for the extension of the patent validity to compensate for the delay in granting this right by the INPI (National Institute of Industrial Property) – focusing, in this case, only on patents related to pharmaceutical processes and products .
On the 14th, the decision should go through the plenary session of the STF, which postponed the judgment, initially scheduled for this Wednesday, of ADI 5.529 (Direct Constitutionality Action), questioning the validity of the Sole Paragraph of Art. 40.
