Bill on the Regulation of the Industrial Property Agent Profession is Now in the Brazilian House of Representatives
On October 9, Congressman Julio Lopes (PP-RJ) introduced Bill 3,876/2024 to the Brazilian House of Representatives to regulate the Industrial Property Agent profession and establish a regulatory and oversight body.
The text outlines the various duties of an Industrial Property Agent, including legally representing individuals in matters of industrial property protection, acting before relevant government bodies, advising and representing individuals and companies in obtaining and maintaining rights related to trademarks, patents, and others, as well as providing consulting services for obtaining the necessary licenses for the manufacturing and commercialization of products regulated by the government.
Within 120 days of the law’s enactment, the BPTO will publish the list of Industrial Property Agents registered up to 2014, including their names and registration numbers, and make the files and records of these professionals available to the regulatory body overseeing the profession.
The bill also creates the Brazilian Federal Council of Industrial Property Agents as the regulatory and oversight body for the profession of Industrial Property Agent. It also establishes that the Brazilian Association of Industrial Property Agents (ABAPI) will assume the role of the Brazilian Federal Council of Industrial Property Agents. ABAPI will have up to one year after the law’s enactment to comply with the regulations governing Brazilian Federal Professional Councils.
The bill is currently awaiting review by the Speaker of the House of Representatives.
