Registration for the 5th CSD-ABPI Moot is open until July 8


Team registration for the 5th CSD-ABPI Moot closes on July 1. The competition will take place on August 15 and 16 at the Mattos Filho law firm in Rio de Janeiro, located at Praia do Flamengo, 200, 11th floor.

This year, participants will address a fictional dispute between cosmetics companies involving allegations of trademark and trade dress infringement, unfair competition, and questions concerning arbitral jurisdiction over the matter.

Inspired by other renowned moot court competitions and following the resounding success of its first four editions, held in 2021, 2022, 2023, and 2025, the CSD-ABPI Moot has established itself as Brazil’s first competition dedicated exclusively to two of the most compelling areas of law: Arbitration, from a procedural perspective, and Intellectual Property, from a substantive perspective.

More than a competition, the CSD-ABPI Moot offers participants an opportunity to deepen their knowledge, develop oral advocacy skills, and gain practical experience with the challenges of applying arbitration to Intellectual Property disputes.

The competition will precede the ABPI 2026 Global Meeting on Innovation and Intellectual Property, Latin America’s largest Intellectual Property congress, reaffirming CSD-ABPI’s commitment to the practical training of students and young professionals in Arbitration and Intellectual Property.

The schedule has been arranged so that members of registered teams can also attend Young IP Professionals Day, which will take place on Sunday, August 16, beginning at 1:30 p.m.

Fictional case defined
The fictional case for the 2026 edition involves a Request for Commencement of Arbitration Proceedings arising from a dispute between companies in the cosmetics sector regarding alleged trademark infringement, trade dress violations, unfair competition, and controversies related to arbitral jurisdiction over the matter.

The topic is highly current and reflects contemporary legal challenges involving intellectual property, business contracts, arbitration, and the creative economy. The case addresses relevant issues related to the protection of trademarks and product trade dress, coexistence and cancellation of distinctive signs, limits of arbitration clauses, the competence-competence principle, and the interaction between arbitration and the Judiciary in intellectual property disputes.

The case is already available on the 5th CSD-ABPI Moot website and may be accessed by Teams and by those who will follow the Competition as arbitrator evaluators or observers.
