Registration via Madrid Protocol starting in October

The Brazilian Patent and Trademark Office – BPTO estimates that trademark registrations of Brazilian companies abroad via Madrid Protocol shall start operating as of October this year. Newly approved by the Federal Senate, Draft Legislative Decree No. 98/2019, which allows Brazilian accession to the Madrid Protocol, provides that the analysis of the request must be carried out within 18 months of the trademark request. According to the BPTO in April 2019 the waiting time until the examination of trademark applications was of nine months.
