CSD-ABPI signs agreements with LES Brazil and ABES
ABPI’s Dispute Resolution Center (CSD-ABPI) is expanding its scope of activities and recently signed two agreements with two important associations: LES Brazil, affiliated with the Licensing Executives Society International (LESI), which promotes licensing and technology transfer culture in Brazil through professional qualification, partnership building, and responsible exploitation of Intellectual Property rights; and ABES – Brazilian Association of Software Companies, an entity that represents not only software development companies and related service providers but also users and companies interested in the information technology sector. The signed agreements envisage a schedule of actions involving the four chambers of CSD-ABPI – Mediation, Arbitration, Domain Names, and Digital Law – such as dissemination, events, and expert training.
The CDD-ABPI
The newly created Digital Law Dispute Resolution Chamber (CDD-ABPI) of CSD-ABPI specializes in resolving disputes in the field of digital law, including privacy protection, data protection, personality rights, and information security; distribution, display, provision, and/or use of online content; contracts involving cloud computing, software, hardware, and related services; smart contracts and blockchain; cryptocurrencies and crypto-assets; and e-commerce.
The CDD-ABPI is already operational and currently handling three procedures: determination by expert, mediation, and arbitration. The procedures are entirely online and designed to be simple, agile, and flexible. One of the advantages is predictability, as the fee schedule, available on the CSD website, sets a fee ceiling for each procedure. Another advantage is speed, with mediation expected to take 30 days and determination by experts and arbitration cases expected to take 90 days.
