BPTO leaves the Brazilian Ministry of Economy
The government published Decree No. 11,340, of January 1st, 2023, in the Brazilian Official Gazette, which determines the return of the BPTO, as well as the Intellectual Property policies – previously allocated to the Ministry of Economy – to the Ministry of Development, Industry, Commerce and Services (MDIC).
The Decree, in its article Art. 46, establishes that it is incumbent upon the Department of Intellectual Property Policy and Metrology under the scope of the MDIC:
I – Formulate and implement programs, policies, and actions related to intellectual property and technology transfer;
II – Formulate and implement programs, policies, and actions related to metrology, standardization, and industrial quality;
III – Advise and coordinate the government position on intellectual property policies, technology transfer, metrology, standardization, and industrial quality; and
IV – Exercise the Executive Secretariat of the Interministerial Group on Intellectual Property and provide technical assistance to it.
