In 2026, the 5th CSD-ABPI Moot, the mock arbitration competition organized by ABPI’s Center for Dispute Resolution, will be held in person on August 15 and 16, ahead of ABPI’s Global Meeting on Innovation and Intellectual Property, in Rio de Janeiro. Discounted registration is available until June 15.
Fictional case defined
The fictional case for the 2026 edition involves a Request for Commencement of Arbitration Proceedings arising from a dispute between companies in the cosmetics sector regarding alleged trademark infringement, trade dress violations, unfair competition, and controversies related to arbitral jurisdiction over the matter.
The topic is highly current and reflects contemporary legal challenges involving intellectual property, business contracts, arbitration, and the creative economy. The case addresses relevant issues related to the protection of trademarks and product trade dress, coexistence and cancellation of distinctive signs, limits of arbitration clauses, the competence-competence principle, and the interaction between arbitration and the Judiciary in intellectual property disputes.

Who may participate
Educational institutions offering undergraduate and graduate law programs, law firms registered with the Brazilian Bar Association (OAB), and academic/student organizations may participate in the 5th CSD-ABPI Moot. Registrations are already open and may be submitted via email to moot@csd-abpi.org.br.
This year, specialized professionals may also apply to serve as arbitrators for the 5th CSD-ABPI Moot. Arbitrators will play a fundamental role in the Moot by questioning the teams’ arguments, evaluating performances, and directly contributing to the success of the competition. Registrations to serve as an arbitrator in the 5th CSD-ABPI Moot may also be submitted via email to moot@csd-abpi.org.br.
