ABPI has submitted its recommendations as part of the ongoing review of the Uniform Domain Name Dispute Resolution Policy (UDRP), a process led by the WIPO Arbitration and Mediation Center (World Intellectual Property Organization) in collaboration with the Internet Commerce Association (ICA). The review of the draft report was conducted by the leadership of ABPI’s Domain Name Dispute Resolution Chamber (CASD-ND), part of its Center for Dispute Resolution, Mediation, and Arbitration in Intellectual Property (CSD-ABPI).
On behalf of ABPI, CASD-ND Director Wilson Pinheiro Jabur and Deputy Director Fernanda Beser submitted a detailed document offering a wide range of contributions to the WIPO-ICA process. These included suggestions on expanding the scope of rights covered by the UDRP, developing educational materials, compiling case law, standardizing decision formats, and other key topics.
The UDRP, developed by ICANN—the global authority responsible for setting domain name registration policies and procedures—provides a mechanism for resolving disputes over domain names that infringe on trademarks.
To guide the UDRP review, WIPO and ICA assembled a team of global leaders and experts in the field. A final report will be submitted to ICANN for consideration in any future revisions of the policy. ABPI will continue to monitor developments and engage in the process.
