Event: A Dialogue on Disputes and Franchising
On November 5th, the CSD-ABPI will host the “A Dialogue on Disputes and Franchising – Topics of Interest in Arbitration and Mediation” event at ABPI’s headquarters in São Paulo. The event will be hybrid, in person and online.
The event aims to discuss the use of arbitration and mediation in resolving conflicts related to franchising, highlighting strategic issues and best practices for drafting arbitration clauses. The first session, scheduled for the morning ̶ from 8:30 a.m. to 12:00 p.m. (BRT) ̶ will be organized by the Arbitration Chamber of the CSD-ABPI (CArb-ABPI). The second session, in the afternoon ̶ from 2:00 p.m. to 5:00 p.m. (BRT) ̶ will be organized by the Mediation Chamber of the CSD-ABPI (CMed-ABPI).
Panel 1 will address the topic: “The Suitability of Arbitration for Franchise Disputes: Sensitive Issues and Advantages of This Strategic Choice.” The panelists will be Vera Monteiro de Barros, Chair of the Coordination Committee of the OAB/SP Chamber of Mediation, Conciliation, and Arbitration and Director of the Brazilian Arbitration Committee; and Flávia Amaral, member of the Legal Studies Committee of the Brazilian Franchising Association (ABF). Nathalia Mazzonetto, member of ABPI’s Council and Deputy Director of the CArb-ABPI, will serve as the debater.
Panel 2 will begin at 11:00 a.m. (BRT) and will cover the topic: “Arbitration Clauses in Franchise Agreements: ‘Tricks’ and Drafting Considerations.” The speakers will be Antonio Deccache, PhD in Commercial Law from the University of São Paulo’s Law School, Master of Business Law and Economic and Social Development from Fundação Getúlio Vargas Law School, and Master of Laws (LL.M.) from New York University School of Law (NYU); and Cândida Caffé, Coordinator of the Technology Transfer and Franchising Committee at ABPI. The moderator will be Manoel J. Pereira dos Santos.
In the afternoon, the discussions will continue. At 2:20 p.m. (BRT), a lecture titled “The CMED Regulations and Rules and Their Suitability for Disputes Involving Intellectual Property” will be presented by Karin Klempp Franco, Director of the CMed-ABPI, and Marcos Chucralla Moherdaui Blasi, Deputy Director of the CMed-ABPI.
At 3:45 p.m. (BRT), the topic will be “Mediation of Franchise Contract Disputes – Specificities, Recurring Issues, and Best Practices.” The speaker will be Adolfo Braga Neto, mediator, arbitrator, and Dispute Board member, Chair of the Board of Directors of the Brazilian Institute of Mediation and Arbitration (IMAB), and Coordinator of the Ethics Committees at the Brazilian National Council of Mediation and Arbitration Institutions (CONIMA) and the Brazilian Institute of Collaborative Practices (IBPC).
