ABPI Arbitration Chamber Appoints 11 New Specialists
The ABPI Arbitration Chamber (CArb-ABPI) is appointing 11 new franchise specialists. These new arbitrators will join the select and experienced panel of specialists at the Intellectual Property Dispute Resolution Center (CSD-ABPI), which also includes three other chambers: Mediation (CMed-ABPI), Domain Names (CASD-ND), and Digital Law (CDD-ABPI).
Arbitration is a method of resolving disputes between individuals (natural or legal persons) who have an arbitration agreement, without the intervention of the Judiciary. In Brazil, the procedure is regulated by Law 9.307/96, amended by Law 13.129/2015, which allows the parties in dispute to bring the impasse to be resolved by a private individual (arbitrator(s)).
Franchise arbitration, like arbitration in general, offers several advantages, including confidentiality, expertise, flexibility, speed, and neutrality, explains attorney Luciana Morse, who has recently joined the CSD-ABPI panel of arbitrators. “I hope to contribute with my knowledge and experience in franchising and learn from the other arbitrators at CSD-ABPI,” she says.
