This Table Topic debated the ADI 5529 and the unconstitutionality of the sole paragraph of article 40 of the Brazilian Industrial Property Law – Law 9.279/96, which allows for the extension of the patent term in case of delay in the examination of the application by the Brazilian Patent and Trademark Office – BPTO.
